Terms of Use

By downloading or using Calibrate, you agree to these Terms. If you don't agree, please don't use the App.

1. Acceptance of terms

These Terms of Use ("Terms") are a legally binding agreement between you and Calibrate Within ("Developer," "we," "our," or "us") governing your use of the Calibrate mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

2. Description of the App

Calibrate is a personal reflection and attention-awareness application. The App allows you to:

Calibrate is not a medical device, therapeutic tool, or mental health treatment. It is a personal awareness tool and does not provide medical advice, diagnosis, or treatment of any kind.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent's or legal guardian's consent to use the App.

4. User content & data

All content you create in the App (intentions, reflections, notes, habits, and session history) is stored locally on your device, and you retain full ownership of it. We do not access, collect, or store your content on any server. You are solely responsible for maintaining backups of your device; deleting the App permanently removes all locally stored data.

5. Subscriptions & payments

5.1 Trial. Calibrate is free to use with all features open for 14 days after you first open the App. No payment details are required for this trial, and nothing is charged when it ends. Separately, subscriptions may include a free introductory period offered through the App Store; an introductory offer converts to a paid subscription at the end of that period unless cancelled at least 24 hours before it ends.

5.2 Plans. After the trial, core features (including your to-dos, journal, and history) remain free. Premium features require a subscription: $9.99 USD per month or $39.99 USD per year, both auto-renewable. Prices may vary by region and are shown in your local currency in the App; actual pricing is determined by the App Store at the time of purchase.

5.3 Billing & renewal. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period; renewal is charged within 24 hours prior to the period's end. If prices change, you will be notified in advance and the new price applies from the next billing period after notice.

5.4 Cancellation & refunds. Cancel anytime through your Apple ID account settings; cancellation takes effect at the end of the current billing period and you retain access until then. Refunds are handled by Apple under App Store policies; we do not process refunds directly.

5.5 Restore purchases. If you reinstall the App or switch devices, restore your active subscription with the "Restore purchase" option in the App.

The App, including its design, code, graphics, logo, and content (excluding your user-generated content), is the property of Calibrate Within and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, loss of profits, or personal injury) arising out of or in connection with your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the App or violation of these Terms.

11. Termination

We reserve the right to terminate or suspend access to the App at any time, without notice, for conduct we believe violates these Terms. You may terminate your use of the App at any time by deleting it from your device.

12. Third-party services

Purchases are made through Apple's App Store and are governed by Apple's own Terms of Service and Privacy Policy. The App also uses RevenueCat for subscription validation and PostHog for anonymous usage analytics, as described in our Privacy Policy. We are not responsible for third-party services, policies, or actions.

13. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Disputes arising from these Terms shall be resolved in the courts located in California.

14. Severability

If any provision of these Terms is found unenforceable or invalid, it shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

15. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the App, superseding all prior agreements and understandings.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the effective date at the top of this page. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
